LIABILITY RELEASE/WAIVER FORM All participants MUST complete this form WMC GTHA INAUGURATION EVENT All participants must complete and sign this form before participating in the Event. All participants, performers and persons involved in any program or activity at the WMC GTHA Inauguration Event (the “Event”) organized by the World Malayalee Council- Greater Toronto & Hamilton Area (“WMC GTHA”) must complete this form before participating. If the participant is under eighteen (18) years of age, this form must also be signed by the participant's parent or legal guardian. 1. ASSUMPTION OF RISK I, ________________________________________________, understand and acknowledge that participating in, attending, rehearsing for, or otherwise being involved in the Event and its associated activities involves certain inherent and other risks of personal injury, illness, death, property damage or loss. These risks may include, without limitation, risks associated with: dancing, singing, music and musical performances; cultural, theatrical and stage performances; physical activity, movement, acrobatics and choreography; costumes, props and other performance equipment; staging, platforms and stage structures; lighting, sound and electrical equipment; special effects; fire performances, fire juggling and other activities involving fire or heat; interaction with performers, participants, volunteers, contractors or members of the public; rehearsals and backstage activities; event set-up and take-down; uneven, slippery or obstructed surfaces; movement of people and equipment; and the acts or omissions of other participants, performers, volunteers, contractors, service providers or third parties. I acknowledge that not all risks can be eliminated and that some risks may arise from circumstances that are not reasonably foreseeable. RELEASE AND WAIVER OF LIABILITY For purposes of this Release, “Released Parties” means WMC GTHA and its directors, officers, employees, volunteers, agents, representatives, event organizers, program coordinators, contractors, service providers and event sponsors. To the fullest extent permitted by applicable law, I hereby release, waive and forever discharge the Released Parties from any and all claims, demands, actions, causes of action, liabilities, damages, costs and expenses arising out of or relating to my participation in, attendance at, or involvement with the Event, including claims relating to personal injury, illness, death, or loss of or damage to personal property. This release applies to claims arising from or relating to the risks identified in this form, including risks arising from the acts or omissions of other participants, performers, volunteers, contractors or third parties, except to the extent that such liability cannot lawfully be excluded or waived. INDEMNITY I agree to indemnify and hold harmless the Released Parties from and against any claims, demands, actions, liabilities, damages, costs and expenses brought by any person arising out of or resulting from my acts, omissions, negligence, misconduct or failure to comply with reasonable Event rules, safety requirements or instructions, including any injury, death, loss or damage caused by me to another person or to property. SPECIAL PERFORMANCES AND HIGH-RISK ACTIVITIES I understand that certain programs at the Event may involve activities presenting additional or heightened risks, including fire performances, fire juggling, acrobatics, dance, physical performances, stage equipment, lighting, sound equipment, props, special effects and other performance activities. I agree to comply fully with all safety requirements, instructions and restrictions applicable to any activity in which I participate. PARTICIPANT RESPONSIBILITIES I agree to: follow all reasonable safety instructions and Event rules; use equipment, props and other materials only as instructed; remain in areas designated for participants and performers; not participate while impaired by alcohol, cannabis, drugs or any other substance that may affect my ability to participate safely; immediately report any injury, unsafe condition or other circumstance that may affect my ability or another person's ability to participate safely; use reasonable care for my own safety and the safety of others; and conduct myself in a manner that does not knowingly create an unreasonable risk of harm to myself or others. PERSONAL PROPERTY I acknowledge that I am responsible for my own personal belongings, costumes, instruments, equipment, props and other property brought to or used at the Event. To the fullest extent permitted by applicable law, WMC GTHA and the Released Parties are not responsible for the loss of, theft of, or damage to such property. Participant Initials: __________ 7. MEDICAL ATTENTION In the event of an injury or medical emergency, I authorize WMC GTHA and/or Event personnel to obtain reasonable emergency medical assistance for me where they consider it necessary. I understand that WMC GTHA is not responsible for any medical, ambulance, transportation or other expenses incurred as a result of such treatment or assistance, except to the extent that such liability cannot lawfully be excluded. I understand that I am responsible for ensuring that WMC GTHA is informed of any medical condition, allergy, injury or other circumstance that may reasonably affect my safe participation in the Event. Participant Initials: __________ 8. PHOTOGRAPHY, VIDEO AND RECORDING I understand that the Event may be photographed, filmed, livestreamed or otherwise recorded. I consent to WMC GTHA and its authorized representatives photographing, filming or recording my participation in the Event and using my name, image, likeness and/or voice in connection with the promotion, documentation, reporting and archival purposes of WMC GTHA and its activities, without compensation.
